This Personal Use License (“License”) is an agreement between you (“Licensee,” “you,” or “your”) and Yuka / eefoto (“eefoto,” “we,” “us,” or “Creator”). This License applies only to digital products specifically identified as being offered under the eefoto Personal Use License.

License grant

Subject to this License, eefoto grants you a limited, non-exclusive, non-transferable license to use the purchased digital product (“Product”) for your own personal, non-commercial projects.

This License permits personal use only. It does not transfer copyright, ownership, or any other intellectual-property rights in the Product.

Personal use only

You may use the Product for personal and non-commercial purposes, including:

- Personal artwork and creative projects

- Personal websites and social-media posts

- Non-commercial presentations

- Personal crafts

- Private gifts

You may not use the Product in connection with a business, paid service, commercial promotion, client work, or a product offered for sale.

Commercial use

- Commercial use is not permitted under this License.

- Commercial use includes, but is not limited to:

- Selling or licensing the Product

- Using it in work created for a paying client

- Using it in advertising or business branding

- Including it in a product, service, publication, or project distributed commercially

- Printing it on merchandise or physical products for sale

- Using it in monetized content where the Product is a significant design element

To request commercial permission, contact eefoto before using the Product commercially. A separate commercial license may be required.

Prohibited uses

You may not:

- Resell, lease, sublicense, redistribute, give away, or share the original Product file by itself

- Upload the original Product to a website, file-sharing service, marketplace, or other location where it can be downloaded

- Include the original Product in a downloadable collection, asset pack, template, or similar resource

- Claim the Product or any substantially similar version as your own creation

- Remove or alter copyright, watermark, or creator information in a misleading way

- Register or use the Product as a trademark, logo, service mark, brand identity, or official seal

- Use the Product to create or promote an NFT or other blockchain-based asset

- Use the Product for AI training, machine-learning datasets, model development, fine-tuning, testing, benchmarking, or style analysis

- Use the Product as an input, reference, or style reference to generate work that intentionally imitates or reproduces the Product or eefoto’s distinctive style

- Use the Product in unlawful, defamatory, hateful, discriminatory, sexually explicit, or pornographic content

- Use the Product in a way that suggests sponsorship, approval, or endorsement by Yuka or eefoto

Name artwork and official use

Inkan-style and hanko-inspired artwork sold by eefoto is decorative digital artwork. It is not a legal, official, or certified Japanese seal.

You may not use it for:

- Government documents

- Legal documents

- Banking or financial procedures

- Official identification

- Contracts

- Any other purpose requiring an official seal or legal stamp

Copyright and ownership

The Product remains the copyrighted property of Yuka / eefoto.

This License gives you limited permission to use the Product as described above. It does not transfer copyright, ownership, trademark rights, or any other intellectual-property rights.

Termination

This License ends automatically if you materially breach its terms.

If the License ends, you must stop using the Product and delete the original Product file and copies in your possession or control, except where retention is required by law.

Termination does not limit any rights or remedies available to eefoto under applicable law.

No warranty and limitation of liability

The Product is provided “as is,” to the extent permitted by applicable law.

To the extent permitted by law, eefoto is not liable for indirect, incidental, special, consequential, or punitive damages arising from your use of the Product.

To the extent permitted by law, eefoto’s total liability relating to the Product or this License will not exceed the amount you paid for that Product.

Nothing in this License excludes or limits liability that cannot legally be excluded or limited.

Governing law and jurisdiction

This License is governed by the laws of Japan, without regard to conflict-of-law principles.

Any dispute arising from or relating to this License shall be subject to the jurisdiction of the courts of Japan, subject to any mandatory consumer-protection rights that apply.

Relationship to other terms

This License applies only to Products specifically marked as being offered under the eefoto Personal Use License. Other eefoto products may have different license terms. The license identified on the applicable product page controls the permitted use of that Product.

License grant

Subject to this License, eefoto grants you a limited, non-exclusive, non-transferable license to use the purchased digital product (“Product”) for personal and limited commercial purposes. This License does not transfer copyright, ownership, trademark rights, or any other intellectual-property rights in the Product.

Permitted uses

You may use the Product:

- In your own personal projects

- In marketing materials promoting your business

- On your website and social-media accounts

- In advertisements and promotional graphics

- In presentations and business materials

- In monetized videos and other content

- In non-competitive client projects

- In finished creative work delivered to a client

- For personal printing and personal use

The Product must be incorporated into a larger creative work or finished design. You may not provide the original digital file to your client or customer unless eefoto gives written permission.

Client work

You may incorporate the Product into a non-competitive project created for a client.

You must not:

- Transfer the original Product file to the client

- Allow the client to extract and reuse the Product as a standalone asset

- Use the Product in a competing digital-asset, clip-art, stock-art, or POD business

- Represent the Product as artwork created entirely by you

Your client may use the final completed work only as part of the specific project for which it was created.

Merchandise and resale restrictions

This License does not permit you to use the Product on merchandise or physical products intended for resale, including:

- Print-on-demand products

- T-shirts and apparel

- Stickers and decals

- Mugs and tumblers

- Posters and art prints

- Tote bags

- Phone cases

- Stationery

- Other products manufactured or sold for profit

You may print the Product for yourself or as a personal gift, but you may not manufacture or sell products featuring the Product under this License.

A separate merchandise or POD license may be available from eefoto. Please contact us before using the Product on products for resale.

Inkan-style artwork

Inkan-style and hanko-inspired artwork is decorative digital art. It is not a legal, official, or certified Japanese seal.

You may not use it for:

This eefoto Free Manga SFX License (“License”) applies only to eefoto files specifically identified as being available under this License.

“Artwork” means the specific Japanese manga sound-effect PNG file, including any associated preview, title, and metadata provided by eefoto.

Permission

Subject to the terms of this License, Yuka/eefoto grants you a worldwide, royalty-free, non-exclusive license to:

- Download and use the Artwork

- Copy and share the Artwork

- Modify, adapt, or combine the Artwork with other content

- Use the Artwork in personal and commercial creative projects

- Include the Artwork in finished works, including comics, illustrations, videos, websites, social-media content, presentations, and books

This License does not transfer copyright ownership.

Attribution

When reasonably possible, credit the Artwork as follows:

Please include a link to https://eefoto.com when the format allows. You may place credit on a webpage, in a video description, caption, credits section, product description, or another reasonable location.

Attribution is not required where it is genuinely impractical because of the format, size, or nature of the finished work. However, credit is always appreciated!

Restrictions

You may not:

- Claim the original Artwork as your own

- Remove or alter existing copyright or attribution information in a misleading way

- Sell, license, or offer the original Artwork by itself as a standalone file

- Upload the original Artwork to a file-sharing, stock-art, clip-art, or download platform as a replacement for the eefoto download

- Include the original Artwork by itself in a competing asset pack or collection

- Use the Artwork as a trademark, logo, service mark, brand identity, or official seal

- Create or promote an NFT or other blockchain-based asset using the Artwork

- Apply additional legal or technological restrictions that prevent others from using the Artwork under this License

- Use the Artwork in a way that falsely suggests sponsorship, endorsement, or affiliation with Yuka or eefoto

- Use this Artwork for AI training, machine learning, dataset creation, generative-AI input, or the development, testing, or improvement of AI systems without prior written permission.

- Use in physical merchandise is not permitted without separate written permission.

You may use the Artwork in a larger creative work or finished product, including a commercial product, provided that the Artwork is not being sold or distributed as the standalone asset itself.

Respectful use

Do not use the Artwork in unlawful, defamatory, hateful, discriminatory, sexually explicit, or pornographic content, or in a way that promotes violence or harms the reputation of Yuka or eefoto.

Ownership

The Artwork remains the copyrighted property of Yuka/eefoto. This License grants permission to use the Artwork but does not transfer copyright, trademark rights, or ownership.

Termination

This License applies automatically when you download or use the Artwork.

If you violate this License, your rights under it end automatically. Rights and permissions obtained by people who received the Artwork from you will not automatically terminate, provided that they comply with this License.

If you stop the violating use and correct the violation, your permissions may be reinstated as provided by applicable law or at the discretion of Yuka/eefoto.

No warranty

The Artwork is provided “as is” and without warranties of any kind, to the extent permitted by law. Yuka/eefoto does not guarantee that the Artwork will meet your requirements or be free from errors.

Nothing in this License excludes or limits liability where doing so would be unlawful.

Relationship to other terms

This License applies only to Artwork specifically marked as available under the eefoto Free Manga SFX License. Other eefoto products may have different license terms.
